Banify ("Banify," "we," "us," or "our") respects your privacy and is committed to protecting personal information.

This Privacy Policy explains how we collect, access, use, store, disclose, and protect information when you use any Shopify application, website, integration, feature, or support service provided by Banify (collectively, the "Services").

This Privacy Policy applies to our current and future Shopify applications. The types of information we process may vary depending on the specific Banify application you install and the features, integrations, and settings you use.

By installing, accessing, or using our Services, you acknowledge the practices described in this Privacy Policy.

1. Who This Privacy Policy Applies To

This Privacy Policy may apply to:

  • Shopify merchants, store owners, administrators, and authorized users who install or use our apps;
  • Customers and visitors of Shopify stores that use our apps;
  • Individuals whose information is processed through features provided by our apps;
  • Visitors to Banify websites;
  • Individuals who contact us through email, chat, or other support channels.

Depending on the circumstances, Banify may process information either:

  • For its own purposes, such as operating, securing, supporting, and improving our Services; or
  • On behalf of a Shopify merchant, where our app processes customer or store data to provide functionality requested or configured by that merchant.

2. Information We Collect and Process

The information we process depends on the Banify application you use and the features enabled by the merchant.

2.1 Merchant and Store Information

When a merchant installs or uses one of our apps, we may collect or process information necessary to provide the Service, including:

  • Shopify store information;
  • Store identifiers and domain information;
  • Merchant or administrator contact information;
  • App configuration and preferences;
  • Feature settings and customizations;
  • Information necessary to authenticate and maintain the app's connection with Shopify.

2.2 Product, Inventory, and Store Data

Certain Banify applications require access to store data to perform their intended functionality.

For example, BA Low Stock & Countdown Timer may process information such as:

  • Product information;
  • Product or variant information;
  • Inventory or stock-related information;
  • Store settings and app configuration.

We process this information only as reasonably necessary to provide the relevant functionality requested by the merchant.

2.3 Customer Contact Information

Certain applications and features may process customer information on behalf of Shopify merchants.

For example, BA Email Popups & Discount may collect or process:

  • Email addresses;
  • Phone numbers;
  • Popup or campaign interaction data;
  • Subscription or submission information;
  • Other information submitted by a customer through an enabled app feature.

Phone numbers collected through our current popup functionality may be stored for the merchant's use. Banify does not currently send SMS messages through this functionality.

2.4 Usage, Interaction, and Performance Data

We may process information about how the Services and app features are used, including:

  • Popup views and interactions;
  • Campaign engagement;
  • Conversion-related events;
  • Feature usage;
  • App performance information;
  • Error and diagnostic information;
  • Other information necessary to provide analytics and functionality to merchants.

Where applicable, this information may be displayed within the relevant Banify application so that merchants can understand the performance of their campaigns and features.

We do not use identifiable customer information collected through a merchant's store to build marketing profiles for Banify or to market Banify products to those customers.

2.5 Technical and Security Information

When our Services are used, certain technical information may be processed as necessary to operate, secure, and troubleshoot the Services. This may include:

  • IP address;
  • Browser or device information;
  • Session or technical identifiers;
  • Log information;
  • Error reports;
  • Security and diagnostic information.

3. How We Use Information

We use and process information for purposes including:

3.1 Providing the Services

We use information to:

  • Install, operate, and maintain our Shopify apps;
  • Provide requested app features and functionality;
  • Save app settings and configurations;
  • Operate popup campaigns and related features;
  • Process store, product, inventory, and other information required by a specific app;
  • Provide analytics and performance information to merchants;
  • Maintain integrations with Shopify and merchant-selected services.

3.2 Supporting Merchants and Users

We may use relevant information to:

  • Respond to support requests;
  • Investigate technical issues;
  • Troubleshoot errors;
  • Communicate about the Services;
  • Provide customer and technical support.

Banify provides chat and email support. Access to information for support purposes is limited to the relevant information necessary to address the particular request.

3.3 Service Security and Maintenance

We may process information to:

  • Protect the security and integrity of our Services;
  • Detect, investigate, and address technical problems;
  • Prevent unauthorized access or misuse;
  • Maintain and improve the reliability of our apps;
  • Comply with applicable legal obligations.

3.4 Improving Our Services

We may use technical, operational, and usage information as reasonably necessary to understand how our Services function and to improve their performance, reliability, usability, and features.

We do not use customer data collected through a merchant's store for Banify' own advertising or marketing purposes.

4. How We Process Shopify Customer Data

When a Shopify merchant uses a Banify application to collect or process customer information, Banify generally processes that information to provide the Service to the merchant.

For example, customer email addresses collected through a popup may be stored and processed to provide the merchant with the functionality requested through the app.

Customer data may also be transmitted to services selected or configured by the merchant when necessary to provide an enabled integration.

Banify does not use customer data obtained through a merchant's Shopify store for its own independent marketing or advertising purposes.

Merchants are responsible for ensuring that their collection and use of customer information through their Shopify stores and campaigns comply with applicable laws and regulations, including obtaining any required notices, permissions, or consents.

5. Third-Party Service Providers and Integrations

We may use trusted third-party service providers to operate and support our Services.

These may include:

Shopify

We use Shopify’s platform and services to provide our Shopify applications and to access information authorized or made available through the applicable Shopify APIs and permissions.

OVH

Our Services use OVH hosting infrastructure for hosting and data storage.

SendGrid and Brevo

We use SendGrid and Brevo for email-related functionality.

Depending on the applicable feature, these services may be used for:

  • Service-related and transactional communications from Banify;
  • Communications related to merchants and their use of our Services;
  • Email functionality provided through an applicable Banify feature.

Crisp

We use Crisp to provide chat and support services. Information submitted through support communications may be processed to respond to and manage your request.

Merchant-Selected Integrations

Some Banify features may allow merchants to connect optional third-party services, including services such as:

  • Klaviyo;
  • Mailchimp;
  • Google Pixel;
  • Other supported integrations selected by the merchant.

These integrations are not necessarily enabled by default. When a merchant chooses to activate an integration, relevant information may be transmitted to that third-party service as necessary to provide the requested functionality.

The collection and use of information by third-party services are governed by their own privacy policies and practices. Merchants are responsible for reviewing and configuring third-party integrations they choose to enable.

6. Cookies and Similar Technologies

Our Services may use cookies or similar technologies for functional purposes.

For example, a popup or campaign may use cookies or similar storage mechanisms to remember that a visitor has already viewed, interacted with, dismissed, or submitted a popup. This helps prevent the same popup from appearing repeatedly and supports the intended functionality and user experience.

We do not use advertising or marketing tracking cookies by default for these purposes.

You may be able to manage certain cookies through your browser settings. However, disabling functional cookies or similar technologies may affect how certain features operate.

7. When We Share Information

We do not sell or rent personal information.

We may disclose or make information available only where reasonably necessary, including:

7.1 Service Providers

We may share relevant information with service providers that help us operate our Services, such as hosting, email delivery, customer support, security, or technical infrastructure providers.

7.2 Shopify and Platform Services

We may process or exchange information with Shopify as necessary to provide our apps and comply with Shopify platform requirements.

7.3 Merchant-Selected Integrations

Where a merchant enables an integration, relevant information may be shared with the selected third-party service to provide that integration.

7.4 Legal and Security Requirements

We may disclose information when reasonably necessary to:

  • Comply with applicable laws or lawful requests;
  • Protect the security of our Services;
  • Investigate fraud, abuse, or security incidents;
  • Protect the rights, safety, or property of Banify, merchants, users, or others.

7.5 Business Transactions

If Banify is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar transaction, relevant information may be transferred as part of that transaction, subject to applicable law.

8. Data Security

We take reasonable and appropriate measures designed to protect information processed through our Services.

Our data is encrypted, and we apply security and access controls intended to protect information against unauthorized access, alteration, disclosure, or loss.

Access to merchant and customer information is restricted to authorized Banify team members who require access for legitimate support, technical, security, or service-related purposes.

Access is limited to the relevant data necessary to perform the specific task. We do not provide unrestricted access to all data to all team members.

No method of transmitting or storing information is completely secure. While we work to protect information using appropriate safeguards, we cannot guarantee absolute security.

9. Data Retention and Deletion

We retain information only for as long as reasonably necessary to:

  • Provide and maintain the Services;
  • Meet the requirements of the applicable app functionality;
  • Comply with legal obligations;
  • Resolve disputes;
  • Enforce applicable agreements;
  • Meet applicable Shopify data handling, retention, and deletion requirements.

The appropriate retention period may vary depending on the type of information, the app being used, and the purpose for which the information is processed.

App Uninstallation

When an app is uninstalled, we process applicable Shopify app uninstallation events and handle relevant data in accordance with applicable Shopify requirements and our data deletion practices.

Shopify Privacy and Data Deletion Requests

Our systems are designed to receive and handle applicable Shopify privacy-related webhooks and data deletion requests.

Where applicable, relevant data will be deleted or otherwise handled in accordance with applicable legal requirements and Shopify requirements.

10. International Data Transfers

Banify provides Services to merchants and users in multiple countries.

Information may be processed or stored in countries other than the country where the individual is located, including through our hosting and service providers.

Where applicable data protection laws require safeguards for international transfers, we will take appropriate steps to support lawful transfers and protect personal information in accordance with applicable requirements.

11. Your Privacy Rights

Depending on your location and applicable law, you may have rights regarding your personal information.

These rights may include the right to:

  • Request access to personal information we hold about you;
  • Request correction of inaccurate or incomplete information;
  • Request deletion of personal information, subject to applicable exceptions;
  • Request restriction of certain processing;
  • Object to certain processing where applicable;
  • Request portability of certain information;
  • Withdraw consent where processing is based on consent.

European Economic Area, United Kingdom, and Switzerland

Individuals located in the European Economic Area, United Kingdom, or Switzerland may have additional rights under applicable data protection laws, including rights related to access, correction, deletion, restriction, objection, portability, and withdrawal of consent where applicable.

Where Banify processes personal data on behalf of a Shopify merchant, the merchant may be the appropriate contact for certain requests concerning that customer's information. We may assist merchants in handling applicable requests where required.

You may also have the right to lodge a complaint with an applicable data protection authority.

United States and Other Jurisdictions

Depending on your state or location, you may have additional privacy rights under applicable laws.

Banify does not sell personal information.

Where applicable law provides additional rights regarding access, deletion, correction, or other privacy choices, you may contact us to submit a request.

12. Children's Privacy

Our Services are designed for businesses, merchants, and general e-commerce functionality and are not directed to children.

We do not knowingly use our Services to intentionally collect personal information directly from children in violation of applicable law.

If you believe that a child has provided personal information to us in circumstances that violate applicable law, please contact us so we can review and take appropriate action.

13. Merchant Responsibilities

Shopify merchants using Banify remain responsible for their own stores, customer relationships, marketing activities, and legal obligations.

Merchants are responsible for ensuring, where required:

  • Appropriate privacy notices are provided to customers;
  • Required consent or other lawful authorization is obtained;
  • Email, phone, marketing, and tracking activities comply with applicable laws;
  • Customer requests are handled appropriately;
  • Optional third-party integrations are configured lawfully.

Our provision of app functionality does not remove a merchant's independent responsibilities under applicable privacy, marketing, consumer protection, or other laws.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to:

  • Our Services;
  • Our data practices;
  • Applicable legal or regulatory requirements;
  • Security or operational practices.

When we update this Privacy Policy, we will revise the Last Updated date at the top of the policy.

Where required by applicable law or where appropriate based on the nature of the change, we may provide additional notice.
